Terms and Conditions

It is our aim to offer to our customers the best possible service at all times.  We hope that our terms and conditions are clear and concise.  However, please do contact us if you are at all unclear about anything.

Ordering

1. Orders can be placed directly over the web with payment being made securely by Credit Card or Paypal.  To register with Paypal please click . We have chosen Paypal to process your credit card transactions for us as they offer a secure service. If you don't already have a Paypal account please click Here for further details to find out just how easy and simple it is to open a free Paypal account.
2. An Order Form can be printed here and payment can be made by either cheque or postal order. We regret that unfortunately at the moment we cannot accept credit card payments by post.
3. When calculating your carriage charge please do not include the cost of any advertising that you are booking as advertising is not subject to carriage
4. We do our best to maintain sufficient stock levels of all our products so that orders can be processed as soon as possible from receipt of order. Almost all orders are despatched within one working day of receipt of order. If at anytime anything is out of stock we will inform you immediately by email of an expected delivery date.
5. We aim to place any new advertisements on the website between 24 and 48 hours of receipt.
6. We reserve the right to refuse an order.

Overseas Customers

1. Overseas customers must contact us prior to placing an order so that the delivery charges and payment terms can be agreed.
2. Overseas customers please note that you are liable for any import duty levied by your own country.
3. All transactions are processed in Sterling
4. If you wish to purchase supplements for shipment overseas please contact us prior to purchasing as some countries have restrictions on what you are allowed to import, we will not be held responsible if your order is rejected.
   
   

Returns Policy

1. If you return the goods to us (at customers expense) in their original packaging, undamaged and unused within 14 days of receiving them we will refund the cost of the goods
2. It is essential that you obtain proof of posting as Horse and Pony Sales cannot be held responsible for non-receipt of returns.
3. Orders will only be despatched if payment has been received in full.
4. Should your order be damaged on arrival please return them to us and include a receipt for the cost of the postage.  We will endeavor to get a replacement out to you as soon as possible. 

Advertising

We have established the following guidelines to ensure the quality of the classified ads on this web site. Sellers and buyers are responsible for all aspects of the transactions in which they choose to participate. All transactions conducted on this web sites classifieds must be consistent with any applicable legal rules and with this web site's guidelines and Terms of Service.

This web site reserves the right to reject or remove any ad that is not consistent with the letter or spirit of this web site's policies or the law. Please review the guidelines below and make sure any transactions you conduct comply fully.

1. All photographs will be returned by post.  Whilst we will take every care of your photographs we cannot accept liability for any loss or damage.
2. When providing photographs please ensure that you have obtained permission from the copyright holder.
3. There are no refunds if your horse is sold prior to the end of the advertising period.
4. Horse and Pony Sales does not guarantee the content of any of the advertisements placed on this site, purchasers are strongly advised to obtain professional advice before buying a horse.
5. Advertisements are placed on the site as soon as possible, usually within 48 hours of receipt. However, there can be a delay if we are competing or exhibiting at an event.
6. All advertisers are advised to check their advertisement for errors as soon as it has been placed on the website. Whilst every care is taken we cannot accept liability for any errors. We will amend any errors as soon as possible after we have been notified of them.
7. Please advise us as soon as your horse has been sold so that we can keep the site as up to date as possible.
8. We reserve the right to refuse an advertisement.
9. We cannot be held responsible if for reasons beyond our control the site should experience "down time" for a short period of time.

General Information

This web site provides classifieds as a platform for our users to connect with one another. This web site does not participate in, nor is it a party to, any classifieds transactions. This web site does not screen or control users who may sell or buy on the classifieds, nor does this web site review or authenticate all listings, items, or services offered for sale. Therefore, users of this service should be aware that:

- Sellers and buyers are completely responsible for working out the sale and exchange of goods or services.

- Sellers and buyers must resolve any disputes that may arise from classifieds transactions. It is important to use care throughout your dealings with other people in the classifieds.

- Sellers and buyers are responsible for researching and complying with any applicable laws, regulations or restrictions on items, services, or manner of sale or exchange that may pertain to transactions in which they participate.

- Sellers and buyers are responsible for all applicable taxes and for all costs incurred by participating in the classifieds.

General Rules

1. Fraud. You may not use or manipulate this service for any fraudulent activity or purpose, including collecting payment from buyers and not providing the item or service purchased, or filing false claims for insurance payments.
2. Interference. You may not spam our system and/or impose an unreasonably or disproportionately large load on our system. You may not put any material on the classifieds that contains any viruses, trojan horses, worms, time bombs, cancelbots, or other computer programming routines that may damage, interfere with, surreptitiously intercept, or expropriate any system, data, or personal information. You may not solicit this web site's users to post ads on other classifieds sites.
3. Passwords. You are solely responsible for actions taken under your password and should not disclose it to anyone else. You cannot use your password for any unauthorized purpose.

Selling

All sellers must:

1. Comply with applicable laws. You may not offer for sale or sell an item or service to any buyer in a jurisdiction where the item, service, or terms of the sale violate applicable laws or regulations.
2. Provide accurate information. You must accurately describe the item you are selling. You may not include any language in your ad, including the ad title, which may confuse potential buyers or cause your ad to be included in search results to which it is not responsive.
3. Place item in the appropriate category. You must list your item in the most appropriate category. Each item can only be listed in one category.
4. Avoid inappropriate ad content. You may not link to, post, or include advertisements for goods or other materials that: (a) describe items or services that you are not selling in the classifieds, or (b) you do not have right to link to or include. You also may not include any content or images in your ad that are obscene, offensive, harmful to minors, invasive of anyone's privacy, or otherwise inappropriate.
5. Have the rights to and possession of item. You may not offer any item for sale that is not in your possession, you do not have the right to sell, or that does not exist at the time of the ad.


Spam

This web site encourages you to post ads in the classifieds as long as they are not duplicates or other forms of spam. This web site may take action to delete classifieds ads and/or user accounts that we believe are misusing this service. Prohibited spam or otherwise impermissible marketing activities in the classifieds may include, but are not limited to, the following:

1. Posting an ad that is unrelated to the category in which the ad is placed.
2. Posting identical ads in the same category and location.
3. Posting an ad with inappropriate links, titles, descriptions, or unauthorized use of content to which the person posting does not have rights.
4. Posting a multi-level marketing position or other non-traditional job not involving a W2 or 1099.
5. Posting an ad for the sole purpose of collecting user information or raising money.
6. Posting an ad that contains unsolicited or unauthorized advertising or promotional materials. This may include an ad that instruct the user(s) to contact the person/company posting the ad for more information and then require the user to pay a fee for that information.
7. Posting a job ad that requires a monetary investment by the user at any time.
8. Posting an ad that requires a user to register before getting detailed information about the product or position.
9. Posting an ad through unauthorized robots (crawling software).

This web site's Right To Terminate

This web site, in its sole discretion, may terminate any Classified listing or your user account immediately and without notice if (a) this web site believes that you have acted inconsistently with the spirit or the letter of this agreement, or (b) this web site believes you have violated or tried to violate the rights of others. If you see a listing that violates our rules, please let us know by contacting us.

In placing an advertisement on the site you are deemed to have accepted our terms and conditions.

We reserve the right to change or modify these guidelines at any time.

Trade Advertisers

1. We reserve the right to remove an advertisement / banner link if the site to which it is redirected to is either illegal, obscene or has changed its business practice so that it is now in direct competition with ourselves.
2. No refund shall be given if an advertisement is cancelled or removed in accordance with point 1.
3. We cannot be held responsible if for reasons beyond our control the site should experience "down time" for a short period of time.
4. The advertiser will indemnify Horse and Pony Sales fully in respect of any claim made against them arising from the advertisement.
5. The advertiser is responsible for providing all artwork in a suitable format.
6. The advertiser warrants that the advertisement and any information provided for publication in our newsletter does not contravene any of the provisions of the Trade Descriptions Act 1968.
7. Although great care is taken to ensure the reliability and accuracy of any material published on this website, Horse and Pony Sales can accept no responsibility for the claims or statements made by the advertisers.
8. In placing an advertisement on the site you are deemed to have accepted our terms and conditions.
9. Advertisements are not placed on the site until payment has been received in full.

Privacy Policy

1. Horse and Pony Sales has a strict policy of not passing your email address to any third parties. Your email address will be used to contact you with regard to your order or advertisement.  We also email a newsletter approximately quarterly if you do not wish to receive the newsletter please do not hesitate to contact us and your email address will be removed immediately from the mailing list.

Copyright

1. Images on this site are copyright of Horse and Pony Sales. If you download, save, redistribute, publish or sell images without the permission of the copyright owner you are in violation of copyright law. The unauthorised reproduction of any image owned by Horse and Pony Sales is subject to a charge of £5,000 for past usage and removal of the images does not void the £5,000 fee for past usage. The reproduction of any images owned by Horse and Pony Sales shall constitute acceptance of these terms and you will be invoiced accordingly.
